The principal aims of the Environment Agency are to protect and improve the environment in England and Wales, and to promote sustainable development. We play a central role in delivering the environmental priorities of Central Government and the Welsh Assembly Government. The Environment Agency plays a significant role in the spatial planning system. As both a statutory and non-statutory consultee we advise on the formulation of national planning policy and assist in the production of technical guidance. We comment on Regional Spatial Strategies and Local Development Frameworks in England, and the Wales Spatial Plan and Local Development Plans in Wales, including commenting on associated Sustainability Appraisals, incorporating Strategic Environmental Assessment.

We also provide environmental information to help Regional Planning Bodies and Local Planning Authorities to formulate policy options, and we provide timely and practical advice to consultations on planning applications by Local Planning Authorities and pre-application enquiries by developers. In addition we advise on the environmental implications of spatial planning on other environmental strategies and policies, such as River Basin Management Plans arising from the Water Framework Directive.

Development and regeneration have the potential to generate traffic and congestion, leading to air pollution and emissions of greenhouse gases. Low Emission Strategies (LES) help to tackle both problems. LES can be implemented through the planning system by applying a combination of measures tailored to an individual site.

The LES Partnership is a peer group of local authorities and other organisations working together to support the adoption of low emission strategies. Our work is funded by grants from Defra and CLG in combination with significant match/in-kind funding from wider participating organisations. Jointly with Defra, we have produced a guidance document: ‘Low Emission Strategies: Using the planning system to reduce transport emissions’

The Planning Inspectorate’s role is the processing of planning and enforcement appeals and holding examinations into regional spatial strategies and local development plans.
We also deal with a wide variety of other planning related casework including listed building consent appeals, advertisement appeals, and reporting on planning applications called in for decision by the Department for Communities and Local Government, or, in Wales, The Welsh Assembly Government.
Other casework includes various compulsory purchase orders, rights of way cases and cases arising from the Environmental Protection and Water Acts and the Transport and Works, Act and other Highways Legislation.
